Louisiana is adopting a stricter stance against illicit gambling through HB 53, which targets illegal gambling rings, electronic sweepstakes machines, computer-based betting, public gambling, wagering on cockfights, and sports bribery.
Representative Bryan Fontenot brought the bill forward in January. The House voted in favor in March by a margin of 86-11, and the Senate followed with a 27-9 vote in late April. With no amendments attached, legislative officials enrolled and signed the measure before transmitting it to Governor Jeff Landry.
Instead of creating a distinct prohibition for online sweepstakes casinos, HB 53 incorporates gambling crimes into the state’s existing racketeering statute. This offers prosecutors a more expansive legal instrument, allowing them to address repeated illegal gambling operations as part of a coordinated criminal enterprise rather than pursuing individual charges separately.
The severity of the penalties further distinguishes HB 53 from many gambling-related bills in other states. A conviction under its racketeering provisions carries the possibility of up to 50 years of hard labor and financial penalties reaching $1 million.
The bill imposes an even stricter requirement when the racketeering activity involves more than $10,000. Under those circumstances, a mandatory minimum prison sentence of five years applies, with eligibility for parole, probation, or a suspended sentence prohibited.
